To access our services, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Payment Terms

Payment terms, including subscription fees and billing cycles, will be specified during the registration process or on our website. All payments are non-refundable unless otherwise stated or required by law.

Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these Terms. You shall not:

- Attempt to gain unauthorized access to our services or systems

- Attempt to reverse engineer, decompile, or discover the source code of our services

AI-Generated Content and Images

Content Generation
Content generated using our AI tools is provided for your use, but you acknowledge that:
- AI-generated content may contain errors or inaccuracies
- You are solely responsible for reviewing and verifying all AI-generated content before use
- We make no warranties regarding the accuracy, completeness, or suitability of AI-generated content

Image Privacy
Images generated on our platform are stored with obscure, long filenames. While this makes images extremely difficult to discover, they are technically accessible via direct URL. Therefore:
- You should not upload sensitive or confidential information to image generation features
- We cannot guarantee absolute privacy for generated images
- You are responsible for ensuring appropriate content is uploaded

Intellectual Property

Your Content
You retain all rights to the content you submit to our platform. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute your content solely for the purpose of providing our services to you.

Generated Content
You own the output generated by our AI services, subject to compliance with these Terms and applicable law.

Our Content
Decodefy AI and its licensors retain all rights, title, and interest in and to the platform, including all related intellectual property rights. No rights are granted to you other than as expressly set forth in these Terms.

Data Use and Privacy

Your use of our services is also governed by our Privacy Policy and GDPR Statement, which are incorporated by reference into these Terms.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

1. INDIRECT DAMAGES: DECODEFY AI, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES ARISING FROM YOUR USE OF THE SERVICES.

2. MAXIMUM LIABILITY: IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE AMOUNT PAID BY YOU TO DECODEFY AI DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO SUCH LIABILITY.

3. NO WARRANTIES: DECODEFY AI PROVIDES ITS SERVICES ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

4. SERVICE AVAILABILITY: DECODEFY AI DOES NOT WARRANT THAT: (A) THE SERVICES WILL MEET YOUR REQUIREMENTS; (B) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE; OR (D) ANY ERRORS IN THE SERVICES WILL BE CORRECTED.

5. THIRD-PARTY CONTENT: YOU ACKNOWLEDGE THAT DECODEFY AI IS NOT RESPONSIBLE FOR THIRD-PARTY CONTENT ACCESSED THROUGH THE SERVICES, INCLUDING WEB SEARCH RESULTS AND NEWS CONTENT, AND THAT YOU BEAR SOLE RESPONSIBILITY FOR YOUR RELIANCE ON ANY CONTENT GENERATED BY OUR AI TOOLS.

6. USER CONDUCT: YOU SPECIFICALLY ACKNOWLEDGE THAT DECODEFY AI SHALL NOT BE LIABLE FOR USER CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY, AND THAT THE RISK OF HARM OR DAMAGE FROM SUCH CONTENT OR CONDUCT RESTS ENTIRELY WITH YOU.

7. AI LIMITATIONS: DECODEFY AI MAKES NO WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF AI-GENERATED CONTENT OR IMAGES. YOU ARE SOLELY RESPONSIBLE FOR VERIFYING AND VALIDATING ALL AI-GENERATED OUTPUT BEFORE USE.

8. IMAGE PRIVACY: DECODEFY AI SHALL NOT BE LIABLE FOR ANY UNAUTHORIZED ACCESS TO OR DISCLOSURE OF IMAGES GENERATED ON THE PLATFORM, OR FOR ANY CONSEQUENCES ARISING FROM YOUR UPLOAD OF SENSITIVE OR CONFIDENTIAL INFORMATION TO IMAGE GENERATION FEATURES.

Indemnification

You agree to defend, indemnify, and hold harmless Decodefy AI, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with:
- Your access to or use of the services
- Your violation of these Terms
- Your violation of any rights of another
- Your upload of sensitive or inappropriate content
- Your use of AI-generated content or images

Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the services will immediately cease.

Upon account termination or closure:
- Your marketing content and AI generations will be deleted after 30 days
- Your account data will be retained or deleted in accordance with our Data Retention Policy

Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on our website or by email notification. Your continued use of the services after any such changes constitutes your acceptance of the new Terms.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law provisions.

Any dispute arising out of or relating to these Terms shall be resolved through the Centre for Effective Dispute Resolution (CEDR) in accordance with its Model Mediation Procedure. If the dispute is not resolved through mediation within 60 days, either party may refer the matter to the courts of England and Wales.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and GDPR Statement, constitute the entire agreement between you and Decodefy AI regarding our services and supersede all prior agreements and understandings, whether written or oral.
